In these terms and conditions, the terms;
- Captain, Crew, Above decks refer to staff representing the company Above Decks
- Above Decks being the name of the charter company
- Guest/s refer to the hirer
- Vessel refers to the vessel named “Lunasea”
Health and safety
Prior to leaving the dock or taking part in any water sports activity you will have a safety briefing. Please take the time to listen. We never mind you asking questions so don’t be shy.
If you have any medical conditions please inform a member of the crew. We will keep this information confidential as per our privacy notice.
Responsibility of sailing the vessel will be taken by our competent Captain and Crew. Whilst we want you to have an amazing time onboard, we do ask that our guests behave responsibly as Above Decks Crew cannot be held responsible for any injuries incurred due to guests irresponsible behaviour or actions taken against the Captain or Crews instructions. Above Decks reserve the right to cancel your hire session if they feel any guests are likely to cause danger to any person, persons or property. The Captain’s decision is final.
Above Decks are licensed and insured. However, at times the sea state and visibility, can mean that it would not be safe to leave the dock and go out to sea. The decision whether or not to take the vessels out is always the responsibility and decision of the Captain.
Guests acknowledge that there are inherent dangers involved in boating and watersports and understand and agree, by making a booking, that you indemnify Above Decks and its staff of any liability in the event of an accident, death or injury including damage or loss of personal property.
Lifejackets are provided for your safety and must be worn as and when instructed by your Captain and Crew.
Payment
No booking is regarded as confirmed until the booking form and a 50% deposit is received. Full payment is due 7 days prior to the hire.
Refunds and cancellation
Cancellations by us: We reserve the right to cancel any of our hires, at any point due to circumstances outside of our control such as, adverse weather conditions or equipment damage, you will be given a full refund unless an alternative vessel or alternative dates are available and agreed.
Cancellations by you: Cancellation made with less than 7 days notice will not be entitled to any form of refund and the full cost of trip will be due.
We fully understand that circumstances change and are happy to amend or change your booking depending on availability.
Cancellation made with more than 7 days notice but less than four weeks will receive 50% of deposit paid refunded.
Cancellations made with over four weeks’ notice will receive a full deposit refund.
Guests are recommended to consider taking out their own cancellation insurance including coverage for damage, loss of personal effects, death or personal injury.
The vessel is registered for 12 guests and is unable to take any additional passengers. The cost of hire is for the hire of the vessel regardless of the number of guests that attend. There is no discount for smaller groups although smaller groups are always welcome.
Equipment Damage
Above Decks pride ourselves on the high standard of our equipment and vessel. Please inform the Captain or crew of any damage you might find during your hire. We ask our guests to also respect the vessel and its equipment. It’s never cheap to replace or repair damage to a vessel of this size and quality so, unfortunately, we will have to charge guests for any damage to the vessel or equipment they or their party inflict.
Misbehaviour
Whilst this is your day and we would like you to enjoy it in style, the Captain and Crew are responsible for the safety of the guests party. Therefore, anyone who, in the opinion of the Captain or Crew, behaves in such a way likely to cause danger to themselves, other guests and other water users, will be returned to the dock and the hire ended.
Smoking and/or drug taking is strictly prohibited on the vessel.
Hire terminated by us due to misbehaviour, consumption of drugs and smoking onboard will not be entitled to any refund.
Liability
Above Decks insures the vessels for public liability but it will not be responsible for any loss, damage, or injury to the guests party or possessions, howsoever caused. The customer will be liable for a minimum of £300 for any damage.
Food and Drink
Food and drink is provided within your chosen package. Under no circumstances may food or drink be brought on-board by the guests.
Confirmation
By booking a charter you confirm that you agree to be bound by these Terms and Conditions.
